i have a case where 1 staff tender his resignation in 24 hour notice.

We are surprised to receive your resignation letter on ----- which has clearly stated that you will not serve notice period as required in your terms of employment. For this purpose, we would like to bring to your notice the clause in your appointment letter that states as below :
In view of the above, you are required to immediately return to office and complete the notice period of 2 months. Further, you are required to complete a proper handover of your work at
various stages to the concerned person you are reporting to and obtain clearance for the same.
If ncase of your failure to comply withing 48 hours of receiving this letter, you will be liable to pay us an amount of Rs. **** as payment in liue of notice period. If you fail to do so, the company will take legal action for recovery of the same along with the cost of legal action. The company also reserves the right to recover cost of losses on account of your ubrupt departure and consequent impact on our work.
The company will not be responsible for the consequences of the legal action, including impact on your new employment.
