How Do I Get My Credit Report?

Each creditor reports information about personal identity, employment history, credit loans, credit cards, public records and payment history to one or all three Credit Repositories. Commonly known as Credit Bureaus, these Repositories are Equifax, Experian and TransUnion. A credit report from a single Repository may or may not contain all of your credit information. Fortunately, all three credit bureaus offer online access to their copy of your credit file. Additionally, for your convenience, EQUIFAX offers a 3 in 1 report that contains all information from all three credit bureaus.

Disputed Items

Dispute instructions and forms are provided when purchasing credit files. Depending on which Credit Repository you select, your report(s) can be viewed online or mailed to your home. In some instances, if your credit report is delivered online, you may be able to dispute items online. If you receive your reports via mail, disputes will need to be documented and mailed back. In either case, instructions and forms for disputing items are included when purchasing your credit report(s).

What is credit scoring?

Credit scoring is a system creditors use to help determine whether to give you credit. Information about you and your credit experiences, such as your bill-paying history, the number and type of accounts you have, late payments, collection actions, outstanding debt, and the age of your accounts, is collected from your credit application and your credit report. Using a statistical program, creditors compare this information to the credit performance of consumers with similar profiles. A credit scoring system awards points for each factor that helps predict who is most likely to repay a debt. A total number of points — a credit score — helps predict how creditworthy you are, that is, how likely it is that you will repay a loan and make the payments when due.

To improve your credit score, concentrate on paying your bills on time, paying down outstanding balances, and not taking on new debt. It’s likely to take some time to improve your score significantly.

Because your credit report is an important part of many credit scoring systems, it is very important to make sure it’s accurate before you submit a credit application.

How Can I Monitor My Credit?

Up until recently, the only way to monitor your personal credit file was to manually order your report via the phone or mailing in a request. Today you can purchase and view your personal credit report on-line.

Even better, you can sign up with Equifax or Experian to have your personal credit files monitored on an ongoing basis. This means that for an annual fee you will be notified (via email) when something on your credit report changes. Additionally, these monitoring services allow you to view your credit report multiple times throughout the year.

If you or anyone you know has ever been a victim of credit reporting errors, ID Theft or credit fraud, these monitoring services are the peace of mind you’ve been waiting for!

Important! Equifax, Trans Union and Experian are separate companies and are not used by all creditors. Therefore, signing up for a monitoring service with one does not provide monitoring for the others. It’s suggested that you purchase the monitoring service from each.

How Can Someone Steal Your Identity?

By obtaining your name, Social Security number, credit card number, or some other piece of your personal information for their own use. In short, identity theft occurs when someone appropriates your personal information without your knowledge to commit fraud or theft.

Here are some ways that identity thieves work:

They open a new credit card account, using your name, date of birth, and Social Security number. When they use the credit card and don’t pay the bills, the delinquent account is reported on your credit report.

They call your credit card issuer and, pretending to be you, change the mailing address on your credit card account. Then, your imposter runs up charges on your account. Because your bills are being sent to the new address, you may not immediately realize there’s a problem.

They establish cellular phone service in your name.

They open a bank account in your name and write bad checks on that account.

By managing your personal information wisely, cautiously and with an awareness of the issue, you can help guard against identity theft:

Why conduct a background check during pre-employment screening?

Pre-employment screening is not a sign of mistrust or an invasion of privacy, but rather an important step in protecting your company from the risks that come with an untrustworthy employee.  Employers cannot rely on resumes alone to determine which candidates will make good employees. Simply having a background check policy in place encourages applicants to be more forthcoming in their resumes and interviews. Is employment screening expensive? 

Verifying an applicant’s credentials and clear

criminal history can costs less than a few hours on the job which is an excellent return on a small investment.

What are the guidelines for evaluating the credit check? 

Items to look for include: How many accounts, how many accounts are delinquent, how many accounts are outstanding, how much debt is owed, what is the current address, and finally, look at the report in conjunction with what job they are applying. The credit history should not be the sole decision maker in employment decisions, but rather an indication of the credit worthiness of your applicant.

The authorization and release must be a separate document. It is not necessary to list everything, but it must be clearly stated what the purpose is.  CBSi-Insight can offer advice with your release documents.

This depends on access to confidential company information. If an individual has access to confidential company information and/or is dealing with company financials, a credit history is suggested. It is best to consult your attorney regarding your company policy.

Can I perform a civil record search for employment purposes?

No, unless there is a legal justification for not hiring an individual based on civil record searches.

How far back should one go on a criminal background? 

In general, Felony and Misdemeanor checks run for the past seven years. If there is a guilty conviction past 7 years, there are no federal limitations on reporting the information. Individual states may have their own limitations; therefore, it is best to research your state laws. Researchers typically search the past seven years, which is in compliance with the Fair Credit Reporting Act.

If management is anxious to hire quickly and the individual starts before the results are back, is it ok?

This is ok, however, it is advantageous to communicate prior to the offer that the employment is “at will” and conditional based upon the results of the background investigation. If negative results come back that would result in adverse action, HR and Management would need to review the adverse action with the individual in order to proceed with the termination.

Should churches perform background screening?

Yes, it is standard to perform background screening in all industries, including religion.

How should we introduce background screening when it has never been done? 

It is suggested that you have all employees sign the authorization and release. Provide an educational session as to what employment screening is, why it is in place, and the reason for starting the screening (safety for all workforce, etc).

How do you know when running a criminal background check if you are getting the best information?

Traditionally, the best searches are those run on the state/county level. Statistically, 95% of all crimes are committed in the states & counties in which the individual has lived. They can be supplemented by a national criminal search. Running a 10% hit rate on average within the industry is typical.

What is a national sex offender search? 

This database contains currently registered violent and sex offenders with felony conviction records. The data has been compiled from violent and sex offender registries in all 50 states plus DC, Puerto Rico and Guam. Further investigation via statewide criminal record databases or county level research is strongly recommended. Links to each state repository are provided for viewing details of offenders’ records.

What does OFAC stand for and why is it important?

The Office of Foreign Assets Control (OFAC) administers a series of laws that impose economic sanctions against hostile targets to further U.S. foreign policy and national security objectives. This exhaustive report screens the names and descriptor information of people identified as posing a threat to the interests and security of the United States. This screen also runs against a database of known narcotics traffickers, terrorists, and businesses and organizations supporting threatening activities.

Do I need a signed release from the tenant?

Yes, per the Fair Credit Reporting Act, a Landlord must have a separate and distinct tenant release clearly stating that the tenant gives permission to run a credit report and criminal record search.

What if I run the credit and decide not to rent to an individual?

Treat each applicant the same, with respect and dignity. Know your local, state and federal laws (Fair Credit Reporting Act and FACTA) regarding the use of consumer reports. If you are denying occupancy based on the CBSi-Insight consumer report, you are obligated to provide the tenant with a copy of an adverse action letter.

Who should be screened?

Any adult who is going to be living in the rental property should be screened.

Why should every adult living in the property sign the lease?

If a person is not listed as a tenant, the Landlord may not be able to prove occupancy and therefore collect damages. It may be more difficult to evict someone without documentation.

What is a site visit? How long does it take? Why is it necessary?

It takes only a short time to verify your information and assign an account number. Once the site visit is complete, we will send you copies of our research. This non-invasive, 10 minute site visit assures the credit reporting agency that you are a Landlord and you have a legal right to obtain a copy of the tenant’s credit report. This quick inspection is conducted by a licensed inspector who has been approved by the credit reporting agency. An appointment will be made at your convenience. (1) Your driver’s license will be verified. (2) The individual will verify that you have a locked cabinet in which to store the copies of the reports. (3) And check to see that you have a paper shredder.

Why do I have to have a site inspection?

All tenant screening companies must abide by the same law, The Fair Credit Reporting Act. There are no shortcuts or exceptions. All screening companies are required to perform the same inspection in accordance with Federal guidelines.

Why do I need an eviction report?

Your rental property is a large asset. People are evicted for reasons other than non-payment of rent; drug activity, noise ordinance and health code violations.
