What is a Zoning Certificate of Occupancy?

A Zoning Certificate of Occupancy is a permit that approves a change of use (e.g. from a retail store to a restaurant). It does not give permission to construct or occupy a building.

When is a Zoning Certificate of Occupancy required?

A Zoning Certificate of Occupancy is required where there is a change in business use of a building or a unit within a building (e.g. from a retail store to a restaurant or from a manufacturing facility to a warehouse facility). You are not allowed to change the use of any land, building or structure until you have applied for and received a Zoning Certificate of Occupancy, Review subsection 1.1.13 of the zoning by-law.

How do I know if a Zoning Certificate of Occupancy is required?

Check the history of a property to obtain information on the current approved use of a property or building unit. When in doubt, call 3-1 -1 to contact the City's Zoning staff to find out if you need a new Zoning Certificate of Occupancy.

How do I apply for a Zoning Certificate of Occupancy?

Complete the Zoning Certificate of Occupancy application and submit your application at the City's Planning and Building Services Centre, 300 City Centre Drive, 3rd Floor.

A complete Zoning Certificate of Occupancy application includes:

  • Zoning

    Certificate of Occupancy application form

  • One (1) copy of a metric site plan showing the location of the unit and/or area to be occupied, and unit number with site statistics (e.g. parking provided and required, floor area of unit, lot area, building area
  • One (1) copy of a fully dimensioned floor plan measured from the exterior of outside walls to the mid-point of joint partitions of all rooms and areas, and indicating the use of the unit, rooms and/or area to be occupied
  • Fee: $262.00
  • Letter of Use. One (1) copy of a letter outlining in detail the proposed business operation (i.e. what type of business do you conduct, what product or service do you provide, and who do you provide this service to). Specify whether or not there will be any wholesale or retail sales, outdoor storage, a list of all combustible storage and quantities (if applicable), the name(s) of both the tenant and/or agent with business address and phone number, and the total occupant load (number of people, employees, patrons)
  • Other Fees - Zoning Letters

    Residential: $ 157.00
