Virginia (Where I USED to live, never plan on living their again) allows an automatic 5 month extension to the tax deadline, which would be the 15th of October, but do I HAVE to file? It's such a pain. If you had any VA income in 2007 then you are required to file if your income exceeds the VA filing requirement amount. If you're required to file and don't, they can file on your behalf and assess what THEY think that you owe for tax. That will usually be more than you actually owe but unless you file there's no way to prove that.

If your return is complex enough to approach "heart attack" territory, you NEED to file or you will certainly take a bath at the hands of the Commonwealth of Virginia. In that case, contact a local tax pro for assistance.

BTW, if they allow a 5 month extension then you're already 2 weeks LATE. A 5 month extension extends the April 15th filing deadline to Sept 15th, NOT October 15th.
